7. Shortages, Damage or Loss in Transit
If you consider there is a shortage in the quantity of goods delivered, you must notify us within 7 days of delivery and allow us reasonable time to investigate your claim. Our liability for any shortage in the quantity of goods delivered is limited to making up the shortage.
We ensure that all orders are carefully checked and adequately packaged when dispatched. Prior to acknowledging delivery to the carrier, you should ensure that the complete consignment has been delivered. Should there be a shortage or visible damage to outer packaging, the carrier’s note must be endorsed accordingly. Within 7 days of receipt of consignment you must ensure that all goods received are in good order and condition. No damage claims will be considered after 7 days of receipt of goods.
All orders of goods bought new and delivered within New Zealand are insured against damage or loss during transit up to the value of NZ$1500 excluding GST. While we do not accept any liability for goods damaged or lost in transit that exceeds the value of the loss or damage insurance applying to that delivery, details of any claim against the carrier should be advised to us and we will assist where possible.
8. Cancellation & Returns
You may cancel your order up until we have dispatched the goods and receive a refund. Following dispatch of the goods, we will only accept “change of mind” returns if approved by us before you send the goods back and the goods are returned in their original condition (without any cuts, tears, crushing, creasing or damage to the packaging or contents that may prevent us from reselling the goods as new, including manuals, accessory items, batteries, screen protection plastic that was supplied with the goods). You must pay the freight cost of returning the goods and we may charge a restocking fee to cover our administration costs incurred in the original transaction and reversing the purchase.
9. Liability
Instead of any warranty, condition or liability implied by law, should any goods ordered be found to be defective within the manufacturer’s stated warranty period for the goods (if any) or otherwise within 12 months of the date of delivery, provided you contact us promptly to arrange for the defective goods to be returned, we will (at our sole discretion) repair or replace the goods, or refund the price paid. (This does not cover damage from misuse, accident, neglect or improper operation, maintenance, installation, modification or adjustment.) To the extent permitted by law, these are your sole remedies in relation to any defective goods or any default by us under these terms and conditions, and in no circumstances will our liability to you exceed the price of the goods, nor do we accept any liability for any direct loss, consequential loss, loss of data, loss of income or profit, loss of damage to property and/or loss from claims of third parties arising out of the use of this website or supply of any goods by us.
You must ensure that the goods ordered are fit and suitable for the purpose for which they are required – we will be under no liability if they are not. If plans, specifications and/or requirements have been given to you, it is your responsibility to ensure that the goods supplied by us will be satisfactory to meet such plans, specifications and/or requirements.
10. Law
